1. Role Under DPDP Act
- PHIR SHIKSHA acts as a Data Fiduciary with respect to your personal data.
- You, as the user/learner/applicant, are the Data Principal.
- Where we engage vendors or partners to process data on our behalf, such entities operate as Data Processors under our direction and obligation.
2. Categories of Personal Data Collected
We may collect personal data voluntarily provided by you or generated during your use of our services, including:
- identity and contact information
- educational and professional details
- login, authentication, and account data
- device identifiers, IP address, and usage information
- communications exchanged with us
- payment-related information processed through secure third parties
We do not intentionally collect “sensitive personal data” beyond what is strictly necessary for service delivery.
3. Purposes of Processing
Your personal data may be processed for:
- account creation, enrolment management, and service delivery
- communication of academic, vocational, or advisory material
- verification, certification, and placement-related processes
- security monitoring, fraud prevention, and service improvement

4. Consent, Withdrawal, and Deemed Consent

- You may withdraw consent at any time; however, you acknowledge that such withdrawal may restrict or disable your continued access to our services.
- Certain processing may occur under deemed consent, as provided under the DPDP Act, including compliance with legal requests or legitimate business purposes.
5. Rights of Data Principals
Subject to the DPDP Act, you may:

- nominate another person to exercise your rights in the event of incapacity or death

- In accordance with the DPDP Act, services are not intended for children below 18 years without verifiable parental/guardian consent.
- Data of children or persons with disability will only be processed with legally valid consent of the lawful guardian.
7. Sharing and Disclosure
While we do not sell personal data, it may be shared:
- with service providers, academic partners, evaluators, or placement partners
- with payment gateways, hosting providers, and IT service vendors
- with governmental or regulatory authorities where legally required
All such sharing occurs under appropriate confidentiality and security safeguards.
8. International Transfers
Personal data may, subject to government notifications and applicable legal restrictions, be transferred outside India for processing or storage, and by using our services you consent to such transfers.
9. Data Security and Breach Management
We implement reasonable technical and organizational measures to secure personal data; however, no system is entirely immune from risk.
Where legally mandated, data breaches shall be reported to the competent authority and, where required, to affected Data Principals.

12. Duties of Data Principals
In line with the DPDP Act, you agree:
- not to impersonate or provide false information
- to comply with applicable laws while using our services
- to refrain from filing frivolous or malicious complaints
13. Cookies and Tracking Technologies
By continuing to use our services, you consent to the deployment of cookies and similar technologies for authentication, preferences, analytics, and performance enhancement; disabling cookies may limit functionality.
14. Limitation of Liability (Protective Clause)
To the fullest extent permitted by law:
- PHIR SHIKSHA shall not be liable for any indirect, consequential, incidental, or punitive damages arising from lawful processing or accidental breach beyond reasonable control.
- You agree to indemnify and hold PHIR SHIKSHA harmless from claims arising due to your violation of this Policy, misuse of services, or breach of applicable law.
15. Refund Policy Disclaimer
- Fees paid toward registration, enrolment, counselling, documentation, assessment, or academic services are generally non-refundable, except where expressly stated otherwise in a specific program-wise policy.
- Refunds, where applicable, shall be processed solely at the discretion of PHIR SHIKSHA, subject to administrative deductions and verification.
- Non-completion of course, dissatisfaction, or change of personal circumstances shall not, by itself, constitute grounds for refund.
- Digital services already delivered or accessed shall be deemed consumed and non-refundable.
16. No Guarantee of Outcomes
While we endeavour to support learners academically and professionally, PHIR SHIKSHA does not guarantee admission, certification, job placement, examination success, or specific outcomes, which depend on multiple external factors beyond our control.
17. Changes to this Policy
We reserve the right to modify this Policy at any time; continued use of our services after such modification shall constitute deemed acceptance of the revised terms.
